Birch Opinion Available on FedSoc Blog

Judge Birch puts this baby to bed, explaining how Section 2 of the Schiavo law violates Separation of Powers and the Constitution. A must read for those of us balancing the rule of law with our personal feelings about Ms. Schiavo's fate.

Finally someone said it, and in a way I wish I had from the get-go.
In resolving the Schiavo controversy it is my judgment that, despite sincerity and altruistic motivation, the legislative and executive branches of our government have acted in a manner demonstrably at odds with our Founding Fathers' blueprint for the governance of a free people -- our Constitution. - Judge Stanley Birch
This is a strong federalist approach to the Schiavo legislation, and I think the better one to take.

The article I lifted the quote from is here. If anyone has a link to the full text of the opinion, please post it in the comments section.

Condolezza Rice, Toni Jennings...Republican women who need to run for office! How are we going to convince these highly respected individuals to throw their hat in the ring? I think the U.S. is ready for both a black and a woman president (in the same person!), as long as the candidate is Republican!
